Article 17 of Directive 2019/790 of 17th April 2019 on copyright and related rights in the digital single market, known as the DSM Directive, proposes a new legal liability regime for online content-sharing platforms that make available, for profit, a large amount of copyright-protected content that their users have uploaded, in order to communicate it to the public. This text, which has given rise to numerous analyses, fulfils one of the three objectives set by the European Commission when it published its “copyright package” on 14th September 2016, consisting of a Communication, two draft Directives and two draft Regulations.
