1) In the case of commissioned works, their originality is sometimes disputed on the grounds that the constraints imposed by the commissioning party restrict creative freedom to the point that the author cannot mark the work with the stamp of his or her personality.

In a case involving frescos decorating the walls of a museum which had been reproduced to illustrate an advert without the rightowners' authorization, the advertising agency and the advertiser, which were sued for infringement of the rights of the authors of the frescos, objected "that it is not established" that the authors of the frescos, which had been commissioned
